We may aggregate and anonymize your data for research, marketing, and business purposes. We retain your personal data and workout information for as long as your account is active or as needed to provide services. You may request deletion of your personal data by contacting us, subject to legal retention requirements.
Upon account deletion, we will delete or anonymize your personal information within 30 days, though we may retain anonymized, aggregated data indefinitely for research and service improvement purposes. Clubs and Coaches are independent third parties, and any Club-Sponsored or Group Workout is conducted under their sole control and responsibility.
The Platform may provide Ancillary Guidance through AI features or Coaches, including computed daily energy (calorie), carbohydrate, protein, and fat targets based on the profile and training data you provide. All such guidance is informational and educational; it is not medical, nutritional, therapeutic, or professional advice, is not a substitute for advice from a physician or registered dietitian, and may not be appropriate for your individual needs. You are solely responsible for evaluating and applying any Ancillary Guidance and for consulting appropriate professionals when needed.
Nutrition and fueling guidance is not intended for individuals with an eating disorder or a history of disordered eating, diabetes or other metabolic conditions, individuals who are pregnant or breastfeeding, or anyone with a medical condition affecting nutrition. Upon termination, your right to use the Service will cease immediately.
We may revise these Terms of Service from time to time. If we make material changes, we will provide notice by email or in-app notification at least fourteen (14) days before the changes take effect, and we will update the "Last updated" date below. Changes to Section 30a (Dispute Resolution) will not apply to disputes that arose before the change took effect. Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms.
ADDITIONAL DISCLAIMERS FOR AI FEATURES: In addition to all other limitations of liability in these Terms, you specifically acknowledge and agree that:
ACKNOWLEDGMENT: By using AI features, you acknowledge that you have read, understood, and agreed to assume all risks related to AI-generated content and third-party AI data processing.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
We are committed to making the Service accessible. If you encounter accessibility barriers or have suggestions, please contact us using the information in Section 32.
TO THE FULLEST EXTENT PERMITTED BY LAW, TRANSITION AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND, TO THE EXTENT THEY USE THE PLATFORM IN THEIR CAPACITY AS COACHES, COACHES, SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, LOST PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE (INCLUDING ANY COACHING SERVICES, COACH CONTENT, ANCILLARY GUIDANCE, CLUB-SPONSORED OR GROUP WORKOUTS, OR ACTIVITIES AT THIRD-PARTY VENUES OR LOCATIONS), WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE INCIDENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES. ACCORDINGLY, SOME OF THE ABOVE DISCLAIMERS AND LIMITATIONS MAY NOT APPLY TO YOU AND APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. NOTHING IN THESE TERMS EXCLUDES, RESTRICTS, OR MODIFIES ANY RIGHT OR REMEDY YOU HAVE UNDER MANDATORY CONSUMER PROTECTION LAW THAT CANNOT LAWFULLY BE WAIVED BY CONTRACT.
You agree to notify us in writing of any claim against us within a reasonable time after it arises. Any claim you may have must be brought within one (1) year after the claim arises, or be forever barred, to the maximum extent permitted by law.
You agree to defend, indemnify, and hold harmless Transition and its affiliates, officers, directors, employees, agents, licensors, and, to the extent they use the Platform in their capacity as Coaches, Coaches, from and against all third-party claims, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) your violation of any law or the rights of another person or entity; (c) content you submit to or through the Service; (d) your interactions, agreements, or disputes with any Coach, Club, or Sponsor; (e) your participation in any Club-Sponsored or Group Workout (including travel to and from the activity) or any in-person or remote session arranged through the Platform; and (f) your misuse of the Service or of any API key or third-party connection you authorize.
We shall not be liable for any failure or delay in performance under these Terms due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or government actions.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Oklahoma, United States, without regard to its conflict of law provisions. Subject to Section 30a (Dispute Resolution), any legal action or proceeding arising under these Terms that is not subject to arbitration will be brought exclusively in the federal or state courts located in Tulsa County, Oklahoma, and you consent to the jurisdiction of such courts. If you are a consumer in a jurisdiction whose laws grant you the right to bring proceedings in your local courts or to the protection of your local law, nothing in this section deprives you of that right.
Before filing a claim, you and Transition agree to try to resolve the dispute informally. Send a written notice describing the dispute, your name, and your account email to the contact in Section 32. You and Transition agree to negotiate in good faith for at least sixty (60) days after the notice is received before initiating arbitration or litigation. This is a condition precedent to starting any formal proceeding.
Except as provided below, any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. The Federal Arbitration Act governs the interpretation and enforcement of this agreement to arbitrate. The arbitration will be conducted by a single arbitrator, in English, and may be conducted by videoconference or, if an in-person hearing is required, in the county where you reside. Payment of filing, administration, and arbitrator fees will be governed by the AAA's rules.
Either party may (a) bring an individual claim in small claims court, or (b) seek injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights or to prevent unauthorized access to or abuse of the Service.
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND TRANSITION EACH WAIVE ANY RIGHT TO A JURY TRIAL AND ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS-WIDE ARBITRATION, OR REPRESENTATIVE PROCEEDING. Disputes will be resolved solely on an individual basis, and the arbitrator may not consolidate more than one person's claims.
If twenty-five (25) or more similar demands for arbitration are filed against Transition by the same or coordinated counsel, the parties agree the demands will be resolved in staged proceedings: ten (10) cases selected by each side will proceed first, and the remaining cases will not be deemed filed (and no fees will be owed on them) until the staged cases conclude and the parties have attempted in good faith to resolve the remaining cases. Applicable statutes of limitations are tolled for cases held in abeyance under this paragraph.
You may opt out of this agreement to arbitrate (but not the rest of these Terms) by emailing the contact in Section 32 with your name and account email within thirty (30) days of first accepting these Terms. If you opt out, disputes will be resolved in the courts identified in Section 30.
If any portion of this Section 30a is found unenforceable as to a particular claim or request for relief, then that claim or request (and only that claim or request) will proceed in the courts identified in Section 30, and the remainder of this Section will continue to apply.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Transition regarding the use of the Service and supersede all prior and contemporaneous written or oral agreements.
You may not assign or transfer any rights or obligations under these Terms without our prior written consent. We may assign or transfer these Terms in connection with a merger, acquisition, or sale of assets, or by operation of law.
We may provide notices to you via email, in-app messages, or by posting on the Service. You must send legal notices to us using the contact information in Section 32.
Any provisions that by their nature should survive termination of these Terms will survive, including but not limited to ownership provisions, disclaimers, and limitations of liability.
The Service is operated by Storybooks LLC, 7631 S Joplin Ave, Tulsa, OK 74136, United States. If you have any questions about these Terms of Service, or to send a notice required under these Terms, contact us at [email protected] or by mail at the address above.
